Experience: 18 Damage Lawsuits
In 18 suits, we assisted
clients in assessing cable damage. Our experiences in field installation and in
training more than 7700 installers enables us to analyze repair costs
accurately. Detailed analysis of repair costs often reveals hidden upgrade or unnecessary
costs, for which the client is not responsible. Usually, these analyses have
justified reduction in repair costs.

Experience:
6 Loss of Use Lawsuits
In six cases, we assisted
clients in assessing loss of use claims. Our experience and knowledge enables
us to evaluate such claims on the technical level.?? Our experience is in
designing and delivering network design training programs to more than 3300
designers. Our knowledge of the structure and functioning of the fiber network
enables us to evaluate loss of use claims realistically. In most cases, our analysis
reveals loss of use claims to be excessive and/or unjustified. In some cases,
our analysis revealed the actual loss of use, were it justified, was
significantly less than the value claimed. This aspect of our technical service
strengthened the legal position significantly. These activities have resulted in
3 written declarations and 3 depositions.

Experience: 6 Installation Lawsuits
In six lawsuits, we assisted
attorneys in evaluating installation defects and damage. Our experience and
knowledge both in field installation and installation training is significant.
This experience includes training more than 7700 installation personnel.
Additional experience and knowledge resulted from our activities as a Director
of the Fiber Optic Association (FOA) and certifying more than 1000 personnel.
From the FOA experience, we have developed
a comprehensive understanding of the knowledge, skills, and abilities
that installers must have to be successful. This significant experience and

Experience: 4 Liability Lawsuits
In four cases, we assisted
attorneys in evaluating liability issues. One case was against a manufacturer
whose product proved defective after installation. The client won at trial.
The second case was in support
of an installation organization, whose work was deemed defective by an
organization that intended to provide repair services. The third case involved
a cable manufacturer, whose cable failed after exposure to both high and low
temperatures. This case was complicated by claims of both the manufacturer and
the installation organization against each other. The fourth case involved
defective cable assemblies and inaccurate testing. These activities resulted in
three written opinions and two depositions.
